Return Policy
(A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor to their self-employed professional activity.)
Right of Return
You have the right to cancel this contract within fourteen days without giving any reason. The return period is fourteen days from the day,
- on which you or a third party named by you, who is not the carrier, has taken possession of the goods, provided that you ordered the goods as part of a single order and they are delivered together;
- on which you or a third party named by you, who is not the carrier, has taken possession of the last item of goods, provided that you ordered several goods as part of a single order and they are delivered separately;
- on which you or a third party named by you, who is not the carrier, has taken possession of the last partial shipment or the last part, provided that you ordered goods delivered in several partial shipments or parts;
- in the case of digital content not delivered on a tangible medium (e.g. digital vouchers by email): from the day of the conclusion of the contract.
To exercise your right of return, you must inform us (MissPompadour GmbH, Am Reitfeld 10, 93161 Sinzing, telephone number: +49 941 206 068 20, email address: beratung@misspompadour.de or via WhatsApp to +49 176 222 258 08) of your decision to cancel this contract by means of an unequivocal statement (e.g. a letter sent by post or an email).
You can also use the electronic cancellation function via the "Cancel order" link in the footer of our website. If you use this option, we will immediately send you a confirmation of receipt of your cancellation (e.g. by email).
You can use the attached model cancellation form for your cancellation, but this is not mandatory. To meet the cancellation deadline, it is sufficient for you to send the notification of your exercise of the right of return before the return period has expired.
Consequences of the return policy
If you cancel this contract, we will refund all payments received from you, including delivery costs (with the exception of any additional costs arising from you choosing a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days from the day on which we receive the notification of your return policy of this contract.
For this refund, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees for this refund.
We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.
You must return or hand over the goods to us without delay and in any case no later than fourteen days from the day on which you inform us of your return policy of this contract. The deadline is met if you send the goods before the period of fourteen days has expired.
You will bear the direct cost of returning goods that can be sent by parcel, as well as the direct cost of returning goods that cannot be sent by parcel. The cost for goods that cannot be sent by parcel is estimated at a maximum of approximately 120 EUR.
You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary to check their condition, properties and functionality.
Grounds for exclusion or expiry
The right to a return policy does not apply to contracts:
- for the supply of goods that are not prefabricated and for the manufacture of which an individual choice or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer;
- for the supply of goods that can spoil quickly or whose expiry date would be quickly exceeded;
- for the supply of alcoholic beverages, the price of which was agreed upon at the time of the conclusion of the contract, but which can be delivered no earlier than 30 days after the conclusion of the contract and whose current value depends on fluctuations in the market over which the trader has no control;
- for the supply of newspapers, periodicals or magazines, with the exception of subscription contracts.
The right to a return policy expires prematurely for contracts:
- for the supply of sealed goods that are not suitable for return due to health protection or hygiene reasons, if their topcoat has been removed after delivery;
- for the supply of goods if, due to their nature, they have been inseparably mixed with other items after delivery;
- for the supply of audio or video recordings or computer software in a sealed package, if the topcoat has been removed after delivery;
- for the provision of digital content (e.g. digital vouchers) if we have commenced performance of the contract after you have expressly consented to us commencing performance of the contract before the expiry of the return policy period, and you have acknowledged that by giving your consent you lose your right to a return policy once performance has begun.
